"Site" is a website located on the Internet at the address : https://top2u.io and its mobile version (hereinafter - "site", "Executor's website"). "User" - any natural or legal person who accesses or uses the site https://top2u.io , the services of the Contractor, from any type of device, regardless of whether such a person is a registered or unregistered user (hereinafter - "User", "Users"). "Agreement on provision of services" – electronic the contract for the provision of services concluded by the User by acceptance of the Contractor's Offer (hereinafter referred to as the "Agreement", "Agreement for the provision of services"). "Services" are services provided by the Contractor to Users access to sports statistics, sports results and betting coefficients in real time, as well as access to sports news and online broadcasts for various sports using the website https://top2u.io and other software and technical products of the Contractor. "Offer of the Performer" - an offer that is publicly available on the Internet on the website of the Performer at the address : https://top2u.io/en-ua/terms and is an offer to conclude an electronic contract for the provision of services on the terms determined by it (hereinafter - "Offer", "Offer of the Performer"). "Personal data" is the term exclusively in the definition provided by the current legislation on the protection of personal data, namely: information or a set of information about a natural person who is identified or can be specifically identified. "Processing of personal data" is the term exclusively in the definition provided by the current legislation on the protection of personal data, namely: any action or set of actions, such as collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution ( distribution, implementation, transfer), depersonalization, destruction of personal data, including using information (automated) systems. "Consent to the processing of personal data" is the voluntary expression of the User's will to grant permission for the processing of his personal data in accordance with the purpose of their processing formulated in this Privacy Policy, expressed in the form provided for in this Privacy Policy.

Top2u platform and the Contractor's services in the manner and under the conditions specified by the Contractor's Offer means the User's consent to the use and processing of his personal data and the performance of other actions provided for by the legislation on the protection of personal data. The Contractor has the right to request from the User only such information, without which the conclusion and fulfillment of obligations under such an electronic contract is impossible. In turn, the User who accepts (accepts) the Contractor's offer to enter into such an electronic contract is obliged to provide the information necessary for its conclusion. Personal data must be accurate, reliable and updated as necessary, determined by the purpose of their processing. The User must provide information about himself, necessary for the execution of an electronic transaction and identification on the Contractor's website, by entering (creating) a special set of electronic data by the User, as well as performing other actions on the Contractor's website. The Contractor creates appropriate conditions for the protection of personal data of its Users. At the same time, the User agrees that he is responsible for his actions when using the site and services of the Contractor, and for the actions of persons acting on his behalf when using the site and services of the Contractor. The User understands and acknowledges that his careless attitude to the security and protection of his personal data and identification data may result in third parties gaining unauthorized access to the User's personal and other data. In this case, the Contractor is not responsible for any damages caused to the User as a result of such unauthorized access.

All information and data are collected on an "as is" basis and are not changed by the Contractor in the process of their collection. The executor does not process personal data about racial or ethnic origin, political, religious or worldview beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sexual life, biometric or genetic data.

The change of personal data that does not correspond to reality is carried out immediately from the moment the discrepancy is established. Personal data is deleted or destroyed in accordance with the procedure established in accordance with the requirements of the law.

RIGHTS OF THE USER AS A SUBJECT OF PERSONAL DATA

FINAL PROVISIONS

Protection and processing of personal data of users of the Top2u platform is carried out by the Contractor in a manner that complies with the legal basis for the protection and processing of personal data, defined by the current legislation of Ukraine and the EU on the protection of personal data, in particular, the General Data Protection Regulation (GDPR). Along with this, the User understands and agrees that the Executor is a legal entity that was created under the laws of Ukraine, is located in Ukraine and carries out its activities, first of all, in accordance with the current legislation of Ukraine, which may differ or not be the same as the laws the country where the User lives or is located. Therefore, by accessing the Top2u platform and using the services of the Contractor, the User agrees to the transfer and processing of his personal data in Ukraine. If, in accordance with the current legislation of Ukraine, any provision of this Privacy Policy is deemed illegal or invalid in whole or in part, this will not cause other provisions of this Privacy Policy or this Privacy Policy as a whole to be declared illegal or invalid. A provision found to be illegal or invalid in whole or in part will be deemed not to be part of the terms of this Privacy Policy to the extent applicable, and the legality, validity and enforceability of the other terms of this Privacy Policy will remain unaffected. All privacy disputes shall be resolved by negotiation on the basis of this Privacy Policy and the Contractor's Offer. Pre-trial settlement of the dispute is mandatory. In case of impossibility of reaching an agreement through negotiations, the dispute shall be considered in court at the location of the Executor in the manner determined by the relevant legislation in force in Ukraine.
